3. Purposes for which the personal data will be processed, and the legal basis for the processing:
3.1.Data processing for the performance of the contract between you and us (Art.6(1)(b) GDPR)
When using our ZARGES Configurator for stairs and platforms and the ZARGES Configurator for fixed ladder systems (ZARGES Configurators), the following applies: We will process your data for registration in the ZARGES Confogurators, to save the quote, to process your quote and to forward your order to the selected dealer.
If a contract is concluded with us, the following applies: In order to perform the existing contractual relationship, to render the services owed and to send you the contract documents, we and third parties appointed by us or processes will process the following data concerning you, if you have provided such data to us upon concluding the contract or in the course of the contractual relationship:
personal details (company, name, address, telephone, fax, e-mail address and a website, if applicable),
if applicable, bank details (IBAN, bank, account holder) and payment information
3.2.Data use on the basis of your consent (Art.6(1)(a) GDPR)
Where consent has been provided, we will only contact you via the communication channels to which you have consented. We will use your data for the following purposes:

Where you have given us a corresponding SEPA direct debit mandate, we will also use your bank details. Via the SEPA direct debit mandate, we will deduct amounts corresponding to the contractually agreed agreements.

We will also use your personal details to pursue our legitimate interests, except where such interests are overridden by your interests or fundamental rights and freedoms.

Quality assurance: In order to continuously improve our services and products for you, we conduct surveys on your satisfaction and your experiences in your contractual relationship.
Storage of your configuration data when using our ZARGES Configurator for stairs and platforms and the ZARGES Configurator for fixed ladder systems (ZARGES Configurators).
To assert legal claims and defend legal disputes.
Examination and optimisation of processes for needs analysis and direct customer contact.

4.Obligation to provide data
When concluding a contract, the company name, name and address must be provided. If you do not provide us with these details, a contract will not be formed with us. All other data is provided on a voluntary basis.
5.Automated individual decision-making, including profiling
Zarges GmbH does not undertake any profiling measures.
6.Data transfers to a third country
Data transfers to countries outside the EU and the European Economic Area ("third countries") are made within the scope of the administration, development and operation of IT systems. Transfers will only be made in the following cases:

IT service providers for the maintenance of our IT infrastructure.
Collection service providers and lawyers for the collection of receivables and the legal assertion of claims. Where personal data (customer and contact details, payment details and data on the receivable) are transferred to a collection service provider for collection, we shall inform you of the intended transfer in advance.
7.2ndData sources
We process personal data which we have received from you within the scope of our business relations. Where it is required for the provision of our service, we shall process personal data we obtain permissibly from publicly accessible sources (debtor registers, land registers, commercial and association registers, press, internet) or which are lawfully transferred by other third parties (a credit agency or an address service provider).
8.Duration of storage and criteria for determining the duration
We shall store your data for the period of this contract and after termination of the contract with you for a period up to the completion of the tax audit of the last calendar year in which you were our customer. If there are statutory periods of retention, we shall be obliged to store the data until expiry of these periods. After expiry of the statutory retention periods, which primarily arise from commercial and tax law (Sections 147 AO [German Tax Code] and 257 HGB [German Commercial Code] in particular), we shall erase the data.
When using our ZARGES Configurator for stairs and platforms and the ZARGES Configurator for fixed ladder systems (ZARGES Configurators), we shall store your data for the duration of registration until you object to the use thereof.
For the purposes of advertising, we shall store your data until you object to the use thereof, you withdraw your consent or if it is no longer permitted to advertise. We shall store your other data for as long as we require them for the fulfilment of the specific purpose (e.g. performance or processing of a contract) and shall then erase them
once the purpose no longer exists.
